What ClaimUnknownFunds does

ClaimUnknownFunds helps identify and organize excess proceeds claims after a Texas tax foreclosure sale, under Texas Tax Code Chapter 34. When a property sells at a tax sale for more than what was owed, the extra money (the "excess proceeds") is held by the county for the former owner, heirs, or lienholders to claim. We help you figure out whether you may have a claim, gather the paperwork, and connect you with a licensed Texas attorney who files the court petition required to release the funds.

We are not a law firm

ClaimUnknownFunds is not a law firm, and nothing on this website is legal advice. If you move forward, the petition to the court is filed by a licensed Texas attorney, and your attorney-client relationship, if any, is with that attorney, not with ClaimUnknownFunds.

How we are paid

We never ask you for money upfront. Under Texas Tax Code Section 34.04, a non-attorney is not allowed to charge a property owner a fee to recover excess proceeds. Instead, the common arrangement is a court-reviewed assignment or buyout agreement: you assign your interest in the claim in exchange for an agreed amount, and the court examines that agreement before releasing any funds. Texas law caps what an assignee may be paid to no more than 125% of what was paid to you for the assignment. Every agreement is reviewed by the court before any money is released, and everything is put in writing before you sign anything.

The amount you agree to is yours, in full. You do not pay the attorney who files the petition, and you do not pay us. Any cost of pursuing the claim after you sign is ours to cover, not yours.

No guarantee

We cannot guarantee that you have a valid claim, that a court will approve a petition, or any specific dollar amount or timeline. Every case depends on the facts of that property, the sale, and any liens against it. Excess proceeds claims in Texas are decided by a judge, and the process typically takes several months, not days.

Deadlines matter

Texas law requires a petition for excess proceeds to be filed before the second anniversary of the tax sale. After two years, unclaimed proceeds are distributed to the local taxing units and can no longer be claimed. If you believe you may have a claim, do not wait to contact us.

What we ask of you

We ask that any information you give us about your property, your identity, or your relationship to a former owner be accurate and truthful. We will never ask you for your Social Security number, date of birth, or bank account details through this website or by text message.

Text messages

If you opt in on our form, you agree to receive text messages from ClaimUnknownFunds about your potential claim. You can opt out at any time by replying STOP. Opting in is never required to use this website or to work with us.

These terms, and any claim we help you pursue, are governed by the laws of the State of Texas.
